Wonder Makers Consulting

PLEASE READ THESE TERMS OF USE ("TERMS OF USE" OR "AGREEMENT") CAREFULLY BEFORE USING THE WEBSITE AND SERVICES OFFERED BY ​WONDER MAKERS CONSULTING (‘WMC’).


BY USING THE WEBSITE AND SERVICES, YOU (‘THE CLIENT’) ARE AGREEING TO BE BOUND BY THIS AGREEMENT WHICH SETS FORTH THE ​LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE WEBSITE AT WWW.WONDERMAKERSCONSULTING.COM AND ANY AND ALL ​SERVICES PROVIDED BY WMC ON AND OFF THE SITE (“SERVICE” or SERVICES”).


This Agreement applies to all users of the Site, including without limitation users who are clients, contractors, contributors of content, ​information, and other materials or services on the Site.


Any new features or tools which are added to the current Site and/or any Service shall be also subject to the Terms of Use. You can review the ​most current version of the Terms of Use at any time at: www.wondermakersconsulting.com/terms-of-service. WMC reserves the right to ​update and change the Terms of Use by posting updates and changes to the WMC website. You are advised to check the Terms of Use from ​time to time for any updates or changes that may impact you.


1. Wonder Makers Consulting and Services Eligibility and Usage Compliance Terms

You represent and warrant that you are at least 18 years old, able to form legally binding contracts under applicable law to use the Site and/or ​any Service and that all registration information you submit, whether to post comments or to make purchases through the WMC Site, is ​accurate and truthful.

  • Individuals under the age of 18 must at all times use the Site and/or any Service only in conjunction with and under the supervision of a ​parent or legal guardian who is at least 18 years of age. In all cases, the adult is the user and is responsible for any and all activities.
  • WMC may, at its sole discretion, refuse to offer access to or use of the Site and Services to any person or entity, and may change its ​eligibility criteria at any time.
  • If you elect to create a WMC Site Account, you must provide your full legal name, current shipping, billing and email addresses, and any ​other information needed in order to complete the signup process. You are responsible for keeping your password to your WMC Site ​account secure. WMC cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and ​password.
  • You may not use the WMC Site or Service for any illegal or unauthorized purpose nor may you, in the use of a Service, violate any laws in ​your jurisdiction (including but not limited to copyright laws and laws regarding online conduct and acceptable content).
  • You are responsible for all activity and content (data, graphics, photos, links) posted to WMC under your name and/or account.
  • You are responsible for all applicable taxes on purchases you make through the WMC website.
  • In addition, you must abide by WMC’s policies as stated in the Terms of Use and all other WMC policy documents (if applicable to your ​activities on or use of the Site) as well as all other operating rules, policies and procedures that may be published from time to time on the ​Site by WMC, each of which is incorporated herein by reference and each of which may be updated by WMC from time to time without ​notice to you.
  • A breach or violation of any of the Account Terms as determined in the sole discretion of WMC will result in an immediate suspension and ​possible termination of your services.


2. SERVICES

Wonder Makers Consulting provides one on one creative consulting services to independent product based brands within the United States.


3. Brand Audit

3.1 Wonder Makers Consulting offers a Brand Audit service. This service provides up to 90 minutes of dedicated work on client-specific goals ​to make generalized improvements to the clients brand ecosystem.

3.2 Clients must agree upon the scope of work and deliverables prior to commencing the service by attending a complimentary 30 minute ​discovery call. The service is designed to be achievable within the allocated time.

3.3 Payment for the Brand Audit is due during the sign-up process.

3.3 No refunds will be issued for work that has been completed in accordance with the agreed-upon scope, even if the client is not satisfied ​with the outcome.


4. Monthly Consulting

4.1 Wonder Makers Consulting offers a Monthly Consulting service. This service provides 2 (60) minute sessions per month of dedicated work ​on client-specific goals to make tangible improvements to the clients brand ecosystem and up to 7 days of voice memo allowance per month.

6.2. Clients agree to attend a minimum of 3 months of Monthly Consulting Services at the time of sign-up.

6.3 Clients agree to a set of customized goals for the duration of their commitment to the Monthly Consulting Service. These goals are not ​subject to a separate agreement but are defined during the sign-up process and confirmed when payment for the service is received.

6.4. Payments for Monthly Consulting are recurring and will be charged automatically to the client's credit card on at the start of each month ​until the service is canceled. Clients must provide 30 days' notice to cancel their Monthly Consulting service.

6.5 No refunds will be issued for work that has been completed in accordance with the agreed-upon scope, even if the client is not satisfied ​with the outcome.


5. Fast Track! Program

5.1. Wonder Makers Consulting offers a Fast Track! Program. This service provides 4 (60) minute sessions for a set duration. of 1 month of ​dedicated work on client-specific goals to make tangible improvements to the clients brand ecosystem as it pertains to a specific event the ​client is hosting or a pivot in the clients business structure.

5.2. Payments for Fast Track! Program is due during the sign-up process. Payment plans can be arranged on a case by case basis.

5.3 No refunds will be issued for work that has been completed in accordance with the agreed-upon scope, even if the client is not satisfied ​with the outcome.


6. REFUND POLICY

If you are not satisfied with our services, you must notify us in writing within 14 days of the work being completed. If your concerns are ​deemed reasonable and justified, we may offer a refund or credit for the disputed services.


7. PRIVACY AND SECURITY

What Information Do We Collect?

We collect information from you when you sign-up for our services or subscribe to our newsletter. When signing up for our services, you will be ​asked to enter your name, e-mail address, mailing address, phone number, and credit card information. When signing up for our newsletter, ​you will be asked to enter your name and e-mail address.


7.1 What Do We Use Your Information For?

Any of the information we collect from you may be used in one of the following ways:

To personalize your experience (your information helps us to better respond to your individual needs)

  • To process transactions.
  • Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason ​whatsoever, without your consent, other than for the express purpose of delivering the purchased product or any Service requested.
  • To administer a contest, promotion, survey or other Site or Service feature
  • To send periodic emails
  • The email address you provide for order processing, will only be used to send you information and updates pertaining to your order unless ​you opt-in to receive Marketing communications during the checkout process.


7.2 How Do We Protect Your Information?

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or ​access your personal information. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure ​Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized ​with special access rights to such systems, and are required to keep the information confidential. After a transaction, your private information ​(credit cards, social security numbers, and/or financials) will not be stored on our servers.


7.3 Do We Use Cookies?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) ​that enables the sites or service providers systems to recognize your browser and capture and remember certain information. We use cookies ​to help us remember and process the items in your shopping cart and compile aggregate data about Site traffic and Site interaction so that ​we can offer better Site experiences and tools in the future. We may contract with third-party service providers to assist us in better ​understanding our Site visitors. These service providers are not permitted to use the information collected on our behalf except to help us ​conduct and improve our business.


7.4 Do We Disclose Any Information To Outside Parties?

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third ​parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this ​information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site ​policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to ​other parties for marketing, advertising, or other uses.


7.5 Third Party Links

Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate ​and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. ​Nonetheless, we seek to protect the integrity of our Site and welcome any feedback about these sites.


7.6 Children’s Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act). We do not collect any information from ​anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.


7.7 Online Privacy Policy Only

This online privacy policy applies only to information collected through our site and not to information collected offline.


7.8 Your Consent

By using our Site and/or Services, you consent to our Site privacy policy.


7.9 Changes To Our Privacy Policy

If we decide to change our Terms of Use or privacy policy, we will post those changes on this page.

8. ELIGIBILITY

8.1 Age: WMC's services are only available, and may only be used by, individuals who are 18 years and older who can form legally binding ​contracts under applicable law. You represent and warrant that you are at least 18 years old and that all registration information you submit ​is accurate and truthful. WMC may, in its sole discretion, refuse to offer access to or use of the Site or Services to any person or entity and ​change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Site is revoked in such ​jurisdictions.


8.2 Compliance: You agree to comply with all local laws regarding online conduct and acceptable content. You are responsible for all applicable ​taxes. In addition, you must abide by WMC's policies as stated in these Terms of Use as well as all other operating rules, policies and ​procedures that may be published from time to time on the Site by WMC, each of which is incorporated herein by reference and each of ​which may be updated by WMC from time to time without notice to you:


8.3 Account Information: You must keep your account information up-to-date and accurate at all times, including a valid e-mail address.


8.4 Other Resources: WMC is not responsible for the availability of outside websites or resources linked to, or referenced on, the Site. WMC ​does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites ​or resources. You agree that WMC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be ​caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or ​resources.


8.5 Notices: Except as explicitly stated otherwise, any notices shall be given by postal mail to Wonder Makers Consulting; Attn: Perri Salka, 291 ​Crown Street, D5, Brooklyn, NY 11225 (in the case of WMC) or, in your case, to the email address you provide to WMC (either during the ​registration process or when your email address changes). Notice shall be deemed given 24 hours after email is sent, unless the sending party is ​notified that the email address is invalid. Alternatively, WMC may give you notice by certified mail, postage prepaid and return receipt ​requested, to the address provided to WMC. In such case, notice shall be deemed given three days after the date of mailing.


9. GENERAL CONDITIONS

You must read, agree with and accept all of the terms and conditions contained in this User Agreement and the Privacy Policy before you may ​become a Client of, or contribute Content to, the WMC Site or any Service.

  • We reserve the right to modify or terminate a Site and/or Service for any reason, without notice at any time.
  • We reserve the right to refuse service to anyone for any reason at any time.
  • Your use of the Site and/or any Service is at your sole risk. The Site and/or any Service is provided on an ”as is“ and ”as available“ basis ​without any warranty or condition, express, implied or statutory.
  • WMC does not warrant that the Site or any Service will be uninterrupted, timely, secure, or error-free.
  • WMC does not warrant that the results that may be obtained from the use of the Site or any Service will be accurate or reliable.
  • You understand that your Content (not including credit card information), may be transferred unencrypted and involve (a) transmissions ​over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit Card ​information is always encrypted during transfer over networks.
  • We may, but have no obligation to, remove Content and/or accounts containing Content that we determine in our sole discretion is ​unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual ​property or these Terms of Use.
  • WMC does not warrant that the quality of any services, information, or other material purchased or obtained by you (The Client) through ​the Site or any Service will meet your expectations, or that any errors in the Site or Service will be corrected.
  • You expressly understand and agree that WMC shall not be liable for any direct, indirect, incidental, special, consequential or exemplary ​damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or ​inability to use the Site or Service.
  • In no event shall WMC or our contractors be liable for lost profits or any special, incidental or consequential damages arising out of or in ​connection with the Site, any Service or this agreement (however arising including negligence). You agree to indemnify and hold us and (as ​applicable) our parent, subsidiaries, affiliates, WMC partners, officers, directors, agents, and employees, harmless from any claim or ​demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Use or any ​documents it incorporates by reference, or your violation of any law or the rights of a third party.
  • Technical support is only provided to paying account holders and is only available via email.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Site or any Service, use of the Site or any Service, or ​access to the Site or any Service without the express written permission of WMC.
  • Verbal or written abuse of any kind (including threats of abuse or retribution) of any WMC client, WMC employee, member, or officer will ​result in immediate account termination.
  • We do not claim any intellectual property rights over the Material you provide to the Site and/or any Site service.
  • The failure of WMC to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or ​provision. The Terms of Use constitutes the entire agreement between you and WMC and govern your use of the Site and any Service, ​superseding any prior agreements between you and WMC (including, but not limited to, any prior versions of the Terms of Use).
  • WMC does not pre-screen Content and it is in its sole discretion to refuse or remove any Content that is available via the Site or any ​Service.
